Rule 5009 allows the debtor to request by motion an order declaring that secured claim(s) have been satisfied and the lien has been released under terms of the confirmed plan.
This event applies only to Chapter 12 and Chapter 13 cases.
1. Select Bankruptcy menu.
2. Select Motions/Applications.
3. Enter case number.
4. Ensure correct case number.
5. Select Docket Event: Declare Secured Claim Satisfied and Lien Released Per Confirmed Ch 12 or Ch 13 Plan (FRBP 5009 (d)).
6. Select attorney, if any.
7. Select party filer:
Party not listed, Add/Create New Party.
8. Browse and select document (PDF file) or scan document.
Attach supportive document, if applicable.
9. Select claim from the list.
10. Enter the name of the claimant.
11. Select “Amended” from the drop down list if this is an amended Motion to Declare Secured Claim Satisfied and Lien Released Per Confirmed Ch 12 or Ch 13 Plan (FRBP 5009(9)).
12. Verify the final docket text before submitting onto case docket.
11. Review the Notice of Electronic Filing. It is your receipt.
