Use this docket event to docket a Modified Ch 13 Plan Before Confirmation. To file a Modified Plan After Confirmation, docket a Motion to Modify Plan After Confirmation.
A Motion to Modify Plan is not required before confirmation.
1. Select Bankruptcy menu.
2. Select Plan.
3. Enter case number.
4. Ensure correct case name and number match the document you are filing.
5. Select Docket Event: Modified Ch 13 Plan Before Confirmation.
6. Check box if joint filing with another attorney.
7. Select party filer.
Pick [Debtor and/or Joint Debtor name].
Reminder: Pursuant to Fed. R. Bankr. P. 3015(d), you are required to serve this document on ALL creditors. File a certificate of service. The court prefers the certificate of service to be attached as the last page of the document, or as a CM/ECF attachment to this document. If necessary, the certificate of service may be filed as a separate docket entry.
8. Browse, verify and attach the document (PDF file).
Attach supportive documents, if applicable.
9. Select appropriate document (docket text) – Chapter 13 Plan.
10. Select any of the following requests that were NOT included with the previous Chapter 13 Plan and are now being added to the amended plan. Then, click the Next button.
Request for valuation of security payment of fully secured claims, and modification of undersecured claims [Part 3.2].
Request for lien avoidance [Part 3.4].
Request to surrender collateral [Part 3.5].
Request for assumption of executory contracts and/or unexpired leases [Part 6].
11. Verify final docket text before submitting onto case docket.
12. Review the Notice of Electronic Filing. It is your receipt.
Note: The court prepares the Notice of Bar Date and serves via the Bankruptcy Noticing Center. The attorney is responsible for serving the Chapter 13 Plan or modified plan on all parties in interest.
